BEFORE THE DISTRICT CONSUMER DISPUTES REDRESSAL FORUM-I, U.T. CHANDIGARH Criminal Complaint No.79 of 2011 in Consumer Complaint No.146 of 1998 Madho Ram Vs. Managing Director, Panchshikha Tourist Resorts Limited PRESENT: Applicant-Complainant in person. Sh.K.K.Saini, Counsel for Respondent alongwith Sh.Om Chand Parwal-Respondent. Dated the 31st day of January, 2012 ORDER Dr.S.K.Dhir, in compliance of the order dated 12.1.2012, filed his affidavit stating therein that keeping in view the critical condition of Sh.Om Chand, he was advised three days bed rest. He has also stated that prescription given with regard to rest is mentioned in the register and its office copy was not retained by him. He has further deposed that he undertakes that he will keep the signed photocopy of prescription given for rest in future. He has further deposed that the record maintained by him is an authenticated record and on each & every page serial number has been mentioned with date. The affidavit filed by Dr.S.K.Dhir did not inspire confidence. Since Dr.S.K.Dhir had stated on oath that in future he will maintain proper record and will also retain photocopy of the prescription, in view of this, he is warned to be careful in future and he is directed to maintain proper and authenticate record with regard to medical certificate issued by him. The certified copy of the order dated 10.1.2012 was placed on record by respondent, whereby the interim order dated 9.11.2011 passed in CA No.599-600 of 2011 was ordered to be continued till further orders. The zimni order dated 28.11.2011 reveals that the respondent had placed on record certified copy of the order dated 9.11.2011 in Company Application No.600 of 2011, whereby the execution proceedings is kept in abeyance till 10.1.2012. Since vide order dated 10.1.2012, the interim order dated 9.11.2011 passed in CA No.599-600 of 2011 was ordered to be continued till further orders, so the execution proceedings cannot be continued, thus are kept in abeyance till further orders as ordered by the Hon’ble Punjab & Haryana High Court. The applicant-complainant has withdrawn the execution application; vide his statement recorded on the execution application itself. Accordingly, the execution application is dismissed as withdrawn.
