                                                                                                JUDGMENT

            Complainant’s husband had taken loan of Rs.35,99,462/- on 17.4.2021 from DCB Bank, Berhampur who is not a party before us.

            Arbitration proceeding was initiated, loan recall notice was already issued much prior to filing of the consumer complaint. Complainant’s late husband was also owner of multiple vehicles as revealed from the final report of Enquiry Officer (S.I. Bikas Kumar Pallai, Berhampur GRPS) dt.29.4.2023.

            The vehicle was insured under Loan Surakshya Policy by opposite party No.4 for which we take a lenient view and direct the opposite party No.4 to settle the claim by taking appropriate step and after recovery of loan amount if any surplus amount remains the same may be paid to complainant.

            Auction purchaser is not a party before us and he should not be deprived of his legitimate right for which opposite party No.5 is free to register the vehicle in the name of auction purchaser.
