ORDER
SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service and unfair trade practice on the part of the opposite parties. After admitting the complainant, notice was issued to the opposite parties. The said notices were accepted by the opposite parties 1 to 3 on 20/06/2024, 20/06/2024 and 27/06/2024 respectively. After accepting the notice, the 1st opposite party failed to appear before this Commission and hence 1st opposite party called absent and set ex parte on 05/08/2024. The 3rd opposite party also filed written version denying the allegation raised by the complainant. When the case came up for consideration on 05/10/2024, both parties submitted that there is a chance of settlement and hence the matter was referred for mediation. When the case came up for consideration today, both parties submitted that the matter is settled. The compromise memo signed by both parties is also filed before this Commission. As per the compromise the 2nd opposite party has agreed to pay a sum of Rs.8,000/- as compensation and a brand new TV (Haier) 43 inch to the complainant within 30 days from the date of settlement. The compromise memo singed by both parties is accepted and recorded. In view of the settlement arrived at between the parties to the proceedings, we find that this is fit case to be allowed in terms of compromise.
In the result the complaint is allowed in terms of compromise. The compromise memo dated 02/11/2024 shall form part of this order. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
