This ex-parte order arise out of complaint filed by the complainant on 25.5.2015 under Section-12 of C.P Act for realisation of fixed deposit amount along with compensation from the OPs
The case of the complainant is that the complainant No.1 is the minor daughter of the complainant No.2 and the compliant No.2 has filed this complaint for both. In the name of complainant No.1 Rs.65000/- was deposited in A/c No.585 dated 25.6.2013 with maturity date 26. 6. 2015 and Rs.45000/-deposited in A/c No.289 on 24.10.2013 with date of maturity on 25.10.2016 with the OP.
The complainant No.2 deposited Rs.12,000/- in A/c No.594 on 21.1.2014 with date of maturity dated 16.8.2014 and Rs.10,000/- in A/c No.599 on 12. 6 .2014 with date of maturity on 16.8.2014 and Rs.20,000/- in A/c No.605
dated 21.8.2014 with date of maturity on 01.10.2014 with the OP. The
complainant No.2 asked for the maturity value of his deposits and the deposit amount of his daughter(complainant No.1) but nothing was paid to him by the OP . Hence the complainant has been filed for realisation of the above amount. This complainant has been admitted in respect of the deposit made by the complainant No.2 in respect of Rs.42,000/-
The OP appeared but at the stage of filling written version remained absent. Hence he has been sat ex-parte on 30.6.2015.
The complainant No.2 filed his evidence on affidavit and the original
fixed deposit receipts of which the xerox copy were filed along with the complaint.
The complainant No.2 in his evidence on affidavit has corroborated the averments made in the complaint and the fixed deposits receipts of account No.594 dated 21.1.2014 for Rs.12000/- with date of maturity on 16.8.2014 and A/c No.599 for Rs.10,000/- deposited on 12.6.2014 having date of maturity on 16.8.2014 and A/c No.605 for Rs.20,000/- deposited on 21..8.2014 with date of maturity on 01.10.2014 . The complainant No.2 though approached the OP for its maturity value with its rate of interest as mention the respective recei9pts but the OP did not respond. The OP did not chose to contest the complaint. So from the sole testimony of complainant No.2 the complaint is allowed due to the deficiency of service of the OP . Hence we order ;
ORDER
The complaint is allowed in part on ex-parte with cost.. The OP is directed to pay the deposited amount in respect of A/c No.594 dated 21.1.2014, A/c No.599 dated 12.6.2014 and A/c No.605 dated 21.8.2014 with its rate of interest as mentioned there in till its payment along with compensation of Rs.5000/- ( five thousand ) only and litigation cost of Res.1000/- (One thousand ) only within two months from the date of this order to the complainant No.2.
