ORDER

For the last two dates the OP had brought cheque of Rs.3,400/-  for payment to the complainant  but the complainant did not appear on those dates.  Accordingly, directions were issued to the OP to send the cheque through registered  post. Today the complainant has come present.    He has been intimated regarding the previous order.  In case the cheque which has been ordered to be sent  to the complainant through post is not received within 30 days from today  the OP shall be liable to pay Rs.5000/- as cost to the complainant alongwith the decreetal amount.  Counsel for the OP has placed on record the proof of sending the cheque to the complainant by post.

 

                   In this view of the matter the complainant wants to withdraw the complaint. In this regard he has appended a note on the execution application itself.

                   In view of the aforesaid statement, this execution application is dismissed as withdrawn being fully satisfied.

                   Certified copy be sent to the parties free of charge. After compliance file be consigned.
