Both parties file hazira. M.A. case is taken up for hearing of the petition dated 20.04.2018 filed by the O.ps. Perused the said petition. Heard both sides. Considered.

By filing the present petition, the O.ps. have prayed for setting aside/vacating the order of ex-parte hearing. It appears from the case record that the O.ps. were absent without step on 17.01.2018 for which the case was ordered to be heard ex-parte. Since this Forum is not empowered to recall it’s own order, so the prayer for vacating the order of ex-parte hearing cannot be entertained. Hence,

O R D E R E D

that the petition dated 20.04.2018 is rejected on contest. M.A. case no. 78/2018 is accordingly disposed off.
