The case  of the complainant is that,  

 

Complainant purchased a LED TV from the first opposite party dealer, manufactured by the second opposite party, by paying Rs.11,000/- on 28/08/17.   Within one week of its purchase it showed complaint in its function.  Immediately the complainant contacted the first opposite party and intimated the matter.  At last on 17/10/17, one person named Sajeev, introduced himself as the authorised technician of the second opposite party,  inspected the TV and he took the TV along with its warranty card on the same day, for curing the defect.  Thereafter the opposite parties has not returned the TV to the complainant.  The complainant stated that even though he paid Rs.11,000/-  to the TV it was functioned only for hardly one week.  Even after repeated requests and demands made by the complainant opposite parties had not cared to return the TV after curing its defect or replaced it with a new one.  The TV is having one year warranty also.  Hence alleging deficiency in service   and   unfair   trade   practice   on   the   part   of   the   opposite  parties

complainant filed this petition seeking relief such as to direct the opposite parties to replace the defective TV with a new one or else direct them to pay its purchase price along with interest, cost and compensation.  

 

Process were issued to the opposite parties 1 and 2 and the same were  duly served.  But the opposite parties failed to appear before this Forum and contest the matter, though sufficient chances were given.  Hence the opposite parties 1 and 2 set exparte and exparte evidence taken.

 

Evidence adduced by the complainant  by way of proof affidavit and documents.  Ext.P1 is the invoice dated 28/08/2017 issued by the first opposite   party.

 

Heard both sides,

 

The point that arose for consideration is whether there is any deficiency in service from the part of opposite parties, and if so, for what relief the complainant is entitled to ?

 

The Point:- The allegation levelled against the opposite parties 1 and 2  are unchallenged, opposite parties miserably failed to appear before this Forum and at least to file a reply version, under the above circumstances, the version of the complainant is admitted and the complaint allowed.  The second opposite party is directed to replace the TV with a new one within 30 days from the date of receipt of the copy of this order and further directed to pay compensation of Rs.5000/- to the complainant.  The first opposite party is directed to pay Rs.3000/- as cost to the complainant within 30 days from the date of receipt of the copy of this order, failing which this amount shall carry 12% interest per annum from the date of default  till the realization.
