Both sides are present through their respective Ld. Counsels.

Today is fixed for final hearing of appeal.

The appeal is taken up for hearing.

At the very outset of hearing Ld. Counsel appearing for the Appellant submits that the Appellant/Complainant, Biresh Chandra Naskar is not willing to proceed further with the present appeal. Ld. Counsel made an endorsement on the margin of the memorandum of appeal as “not pressed voluntarily”.

The present appeal being no. 85/2021 is dismissed being ‘not pressed voluntarily’ at the time of hearing.

Thus, the appeal stands disposed of.

Interim order, if any, stands vacated.

This order is passed and pronounced in presence of both sides.
