Heard Ld. Counsel for the Petitioner, who has joined the proceedings by Video Conferencing, has brought to our attention the Order Sheet of SCDRC, Madhya Pradesh dated 18.01.2024, where the Appeal of the Petitioner was dismissed for non-prosecution.

It is also evident that the notices were issued by the Ld. State Commission on 31.10.2023 in Appeal no. 1386 of 2023 and the matter was fixed for the next date of hearing being 18.01.2024. It is rather surprising to see that on the very first date, after the issue of notice the Appeal had been dismissed for non-prosecution by the Ld. State Commission.

In view of the above circumstances, in the interest of Justice, the Appeal is restored and remanded back to the Ld. State Commission to be decided on merits after hearing both the parties.

Parties shall appear before the Ld. State Commission on 22.11.2024.
