Counsel for the petitioner submits he did not find out the next date of hearing and the case was dismissed in default. This is no ground. It is required that the arguing counsel should be more vigilant while dealing with the cases of litigant. However, in the interest of justice, the appeal is restored, subject to payment of cost of Rs.5,000/-. The same shall be deposited with the State Commission within a period of two weeks.
