The complaint was filed under Section 12 (1) of the Consumer Protection Act,1986. The complainant is absent and has no representation from his side. The first opposite party is represented. The Notice was sent to the complainant on 30.12.2022 and is seen as returned with an endorsement “deceased” as per the proof of the Postal Department. Neither the complainant nor his counsel is absenting since 26.11.2019.

The counsel for the first opposite party submitted that they are not in receipt of a copy of the complaint and documents filed by the complainant hence the first opposite party can’t file their version. The Commission has issued the notice to the complainant twice and no legal hears appeared for the complainant so far.

There is no need to proceed with the case further.

Hence the complaint is closed as the default.
