Final Order / Judgement

                                  Misc.Case No. 291/2021

                                    R.P. No.41/2021

Learned counsel for the petitioner    is present on V.C.

    2.       A Misc. Case is filed for condonation of delay  which shall be registered.

    3.       Heard the learned counsel for the petitioner on the point of limitation.

     4.       Since, there is two days delay and  the order of the Hon’ble Supreme court on the point of limitation is binding, the delay is condoned without prejudice to the rights of the OP.

      5.      Heard the learned counsel for the petitioner on the petition filed. Learned counsel for the petitioner submitted that the learned District Commission passed interim order ex-parte by directing the present petitioner not to disconnect the power supply to the premises of the complainant. Without hearing the present petitioner, he further submitted that there is outstanding of Rs.70,.000/- against the OP.

 6.           At the stage of admission, this Commission do not find any reason to issue notice to the OP. Without going to merit of case, the objection since  has already filed by the present petitioner in the District Commission, the interim matter should be heard  by the learned District Commission by giving opportunity to both the parties.

The Revision petition is disposed of accordingly with direction to learned District Commission to hear on the interim petition and pass order within 30 days from the date of receipt of this order.

Learned counsel for the petitioner is directed to download the impugned order from the website of this Commission or the confonet  and place same before the learned District Commission on 28.06.2021 to take further instruction.
