Learned counsel Mr. J.S. Maharana on behalf of the Appellant is present and filed a withdrawal memo stating that as per the instruction of the E.O., Gunupur NAC/ Appellant, Appellant does not want to proceed with the case further.

In such fact of matter no cause of action survives in the present appeal and hence the appeal has become infructuous.
