                                                Rajendri Devi  Vs. M2M

 

Present:          Sh Parveen Kumar, Advocate for DH.

                        Sh. Rajesh Sharma Advocate for JDs No.3 & 4.

                        An application for withdrawal of present execution filed by ld. Counsel for DH. Ld. Counsel for the DH made a statement that settlement has been effected with the JD and DH has received a DD  bearing no.774390 dated 17.11.2021 amounting to Rs.700000/-(Rupees seven lac only) from the JD. So he withdraws the present execution on behalf of the DH being fully satisfied and the same be consigned to the record room.

                        In view of the statement made by ld. counsel for the DH, present execution is hereby dismissed as withdrawn being fully satisfied.

                        In this execution property of JDs was attached vide order dated 13.11.2020 of this of this Commission and intimation of the same was given to the office of Tehsildar vide letter no. 432 dated 23.11.2020 of this office.  In return, a confirmation letter No.3166 dated 10.12.2020 was issued by Tehsildar Sampla to the effect that the land comprised in Rectangle no.68 Killa No.8(8-0), 10(8-0), 11(8-0) and Rectangle No.69 Killa No.6(8-0) 14(8-0), 15(8-0), 16/1(6-0) 25/2(5-7)  total 59K-7M or 7.418 Acres situated at village Kheri Sadh Tehsil Sampla District Rohtak was attached. Now Tehsildar, Sampla is directed to release the alleged property of JDs attached against execution no.87/19 in case titled as Rajendri Vs. M2M.  Assistant is directed to send a separate letter in this regard to the Tehsildar Sampla.

                         File be consigned to the record room after due compliance.
