ORDER BY HON’BLE MEMBER- MRS. M. SWAIN:
JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking not to repossess AL 2518 T IL bearing Regd. No.OD-21-D-1388 and to supply loan agreement and other documents etc. and pay compensation of Rs.1,00,000/-.
Complainant took loan of Rs.25,00,000/- on 31.12.2015 to repay in 47 monthly EMI @ Rs.71,734/- commencing from 31.12.2015 to 07.8.2018. Complainant failed to pay and violated the agreement for which on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. Complainant is a defaulter of loan as per agreement. Relationship between complainant and opposite parties is that Debtor and Creditor and we find no deficiency in service on the part of opposite parties.
However taking a lenient view we dispose of the consumer complaint directing the opposite parties to supply the loan agreement copy and any other document as required by complainant available with opposite parties. This is a year old case and the loan agreement expiry on 07.12.2019 as per written version submitted by the opposite parties, so there is nothing to adjudicate. Hence the consumer complaint is dismissed. No cost.
Pronounced in the open Commission on this 2nd August,2024.
