ORDER

NEELAM GUPTA, MEMBER:

1. The complainant purchased one Activa 3-G Scooty bearing registration no. PB-11BT-5878 from OP vide invoice no.6382 dt. 16/7/2015. It is alleged that the OP charged Rs.4100/- for the registration of the scooty, but the tax receipt no.7PB07152338 64202 dt.22/07/2015 for the said scooty aggregates to Rs.3134/- thereby showing that the OP charged Rs.966/- in excess for the registration of the vehicle. It is further alleged that the OP also charged Rs.100/- for issuing temporary RC but no such temporary number was ever issued by the OP. Thus the OP illegally and arbitrarily charged Rs.1066/- ( Rs.966/- + 100/-) in excess from the complainant and thus caused him mental as well as monetary loss. The complainant made several requests to the OP but to no use. Ultimately he approached this Forum u/s 12 of the Consumer Protection Act 1986 ( for short the Act).

2. Cognizance of the complaint was taken against the OP, who failed to appear despite service and was thus proceeded against ex-parte.

3. In support of his complaint, the complainant produced in evidence Ex.CA, his sworn affidavit along with documents Ex.C-1 to Ex.C-3 and closed the evidence.

4. The complainant filed written arguments. We have gone through the same, heard the complainant in person and gone through the evidence on record.

5. Ex.C-1 is the copy of the delivery order, which shows the payment of Rs.1814/- towards insurance cum temporary number charges and the payment of Rs.4100/- as registration charges made by the complainant to the OP.

Ex.C-2 is the copy of the receipt of Taxes amounting to Rs.3134/- paid by the OP to the Punjab Motor Vehicle Department for the Registration of the vehicle of the complainant, which clearly shows that the OP charged Rs.966/- i.e. (Rs.4100/- - Rs.3134/- = Rs.966/-) in excess from the complainant for the registration of the vehicle. Ex.C-3 is the copy of the Insurance policy which depicts an amount of Rs.1714/- as Insurance premium. The complainant was never issued temporary registration number, which shows that the OP charged Rs.100/- i.e. ( Rs.1814/- - Rs.1714/-= Rs.100/-) in excess from the complainant.

Today during the course of arguments, the complainant produced one Provisional Registration Certificate which shows its Provisional Registration Number as PB 11-BT-5878 with its validity date from 22/7/2015 to 22/8/2015. Surprisingly the regular registration no. is also the same i.e. PB-11-BT-5878 as provided in Ex.C-2 going to show that provisional registration certificate was prepared fictitiously later on, when Ex.C-2 was issued to cover up the lapse.

In view of the aforesaid discussion, we accept the complaint with a direction to the OP to refund an amount of Rs.1066/- (Rs.966/- + Rs.100/- = Rs.1066/-) to the complainant along with an amount of Rs.25,000/- as compensation for the harassment undergone by the complainant, which is inclusive of the cost of litigation. Order be complied by the OP within a period of one month on receipt of the certified copy of the order.
