Heard the learned counsel for the appellant. In our view, the appellant was not suitably advised to approach this Commission against the order passed by the State Commission. In the facts and circumstances of the case that the scheme in which the complainant got himself registered and deposited the full amount of plot, could not at all take off, the development authority ought to have gracefully refunded the deposited amount with interest. That is what the State Commission has directed in the order. We do not see ..2.. any merit in this appeal and it is accordingly dismissed. However, on request of learned counsel for the appellant, we direct the Registry to refund the amount of Rs.35,000/- deposited by the appellant as pre requisite for filing of the appeal.
