Complainant is present in person.

The case is fixed for W.V . I/D Ex-Parte hearing.

It appears from the record that despite service of Notice O.P. did not turn up to contest the case nor filed any written version within the statutory period.

The case is taken up for Ex-parte hearing.

The Complainant’s case is that he booked an order on 20/01/2023 for purchase of paper cup/plate for Rs.57,010/-  out of which he made an advance payment of Rs.5,000/- on that very day i.e. 20/01/2023 through UPI (Phone Pay)  under UTR No. being 365951593113 and further payment of Rs.49,999/- was made to the O.P. through UPI (Phone Pay) under UTR No.366984112829. Despite full payment to the O.P. the Complainant did not receive the product and further reminder was made to the O.P. by Letter dated: 01/12/2023 for return back the payment of Rs.54,999/-  but the O.P. neither returned the money nor supplied the product.

The Commission has examined the complaint case and the relevant materials on record which establishes the Complainant’s case. It is the duty of the O.P. as product seller to supply the product to the consumer after receipt of payment and failure to do  so amounts to deficiency in service.

The Complainant is entitled to get the relief as prayed for together with compensation for loss of business.

Hence it is ordered…….

That the case be and the same is allowed Ex-parte against the O.P. with cost of Rs.2,000/-.

O.P. is directed to pay to the Complainant Rs.54,999/- with compensation of Rs.5,000/- within a month from this date in default law will take its own course.

Both parties be supplied copy of this Order free of cost.
