The State Commission has dismissed the appeal as barred by limitation. There was a delay of 37 days in filing the appeal. Keeping in view the facts and circumstances of the case counsel for the respondent has no objection to the setting aside of the orders of the State Commission by condoning the delay of 37 days and remitting the case back to the State Commission for a fresh decision on merits according to law. Revision petitions are allowed. The delay of 37 days in filing the appeal before the State Commission is condoned and the case is remanded back to the State Commission to decide it afresh on merits in accordance with law after affording due opportunity of hearing to both the parties. Parties and their counsel are directed to appear before the State Commission on 07.12.2010.
