ORDER

Dated the 14th March, 2013 (In chamber) ORDER 1. This application (RA 44/2013) has been filed under Section 22(2) of the Consumer Protection Act, 1986 for review of the order dated 10.09.2012 passed by this Commission. There is delay of about 128 days in moving this application, for which an application (IA No.1631/2013) for condonation of delay has been filed. The reasons for occurrence of delay in filing the review petition, explained in the application do not constitute ufficient cause and the unexplained delay cannot be condoned. Hence the application for condonation of delay is rejected. 2. Section 22(2) of the CP Act, 1986 clearly laws down that ithout prejudice to the provisions contained in sub-section (1), the National Commission shall have the power to review any order made by it, when there is an error apparent on the face of record 3. The review petition/application runs into 22 pages. It is well settled that a party is not entitled to seek a review of judgement given by this Commission, merely for the purpose of rehearing and a fresh decision of the case. The normal principle is that a judgment pronounced by the Commission is final, and departure from the principle is justified, only when circumstances of a substantial and compelling character make it necessary to do so. The Commission may re-open its judgment, if a manifest wrong has been done and it is necessary to pass an order to do full and effective justice. 4. We have considered all the facts and circumstances of the case. We find no force in the review petition and the same is, therefore, dismissed.
