Final Order / Judgement

Order-2.

Complainant is present through Ld. Lawyer.

                                       The case is taken up for admission hearing.

                                       Heard the Ld. Lawyer for the Complainant. Considered.

                                       Seen the petition of complaint and the Anexures thereto. We find that the relation between the Complainants and the OP is that of Debtor and Creditor. OP has prayed  not to impose interest on the ‘third instalment’ of the loan amounting to Rs.3,50,000/- from the date of disbursement to till the full and final payment.

                                       We find there is no substantive relief as regards the agreement dated 20th July,2011. We do not find any relation of Consumer and Service Provider in the petition of the complaint between parties.

                                       The Complainants do not appear to be Consumer as per Section 2 (1) (d) of CP Act. The dispute involved in this case is not a Consumer dispute. There is also no relation of consumer and service provider between the parties in this case.

                                       We think that the case in its present form is not maintainable before this Forum.

                                       Hence

                                                                                       Ordered

                           That the instant case be and the same is dismissed as being not maintainable in CP Act, 1986 as amended.
