None for the appellant is present. Its counsel are absent. Respondent as well as his counsel are also absent. The record reflects that both the parties as well as their counsel are absent since 22/03/2010. On 03/04/2012 fresh notice was issued to the appellant as well as respondent but no report about service of notice is received. However, on perusal of office copy of the notice it reflects that it was issued on correct address of both the parties. Hence, it will have to be presumed that both the parties are served with notice but nobody turned up. Hence,the appeal deserves to be dismissed in default and accordingly it is dismissed. No order as to cost.
