
M/s Gee City Builders Pvt. Ltd., filed a consumer case on 06 Feb 2018 against Lakhbir Kaur in the StateCommission Consumer Court. The case no is A/204/2017 and the judgment uploaded on 08 Feb 2018.
At the time of arguments, the matter has amicably been settled. Sh.Gaurav Chopra, Advocate, very graciously without conceding anything on merits, as a matter of compassion, stated that the appellant will pay an amount of Rs.1,25,000/- to the respondent/complainant. He further stated that an amount of Rs.25,000/- is lying deposited with this Commission and it may be released in favour of the respondent/complainant, namely, Lakhbir Kaur. He further stated that the remaining amount of Rs.1 lac, will be paid through demand draft to the respondent/complainant within two weeks from today. He assured that an Official of the Company will hand over demand draft, in the said amount, to the Counsel opposite namely Sh.N.K. Bedi, within the said period.
The offer made is acceptable to the respondent/complainant, who is present in this Court and also to her Counsel.
Directions are issued to the Secretary of this Commission for release of an amount of Rs.25,000/- deposited by the appellant with this Commission, to the complainant/respondent namely Lakhbir Kaur, within 7 working days, from today, alongwith interest, if any, accrued thereupon.
We make it very clear that in case the amount of Rs.1 lac is not paid within the time, as undertaken by Counsel for the appellant, it shall carry interest @ 7% per annum, from the date of default, till the date of payment.
The impugned order dated 03.08.2017, passed by the District Forum-I, U.T., Chandigarh, shall not be treated as precedent in other cases of this Company, in lines of the order passed in this appeal.
In view of above, this appeal is disposed of.
