ORDER

Parties by their respective counsel are present and they are heard in reference to the joint application filed by the petitioner and respondent no.1 praying for disposal of the present Revision Petition under the terms and conditions set forth in the joint application.

                                               The terms and conditions are as follows:

 

1. Respondent no.1 shall strike off the name of the Revision Petitioner from arraying as Judgment Debtor/O.P in the Execution Case No.3 of 2023 pending disposal before the Learned District Commission, Imphal.

 

2. The Respondent no.1 shall approach the ld. District Commission, Imphal West to find out of details of the Director of Kangla Housing Construction, (A Unit of Kangla Construction Pvt. Ltd.) i.e. Respondent No.1 of the Consumer Complaint Case No. 12 of 2021 by adducing evidence or otherwise.

 

3. That the Revision Petitioner is ready to give her evidence before the ld. District Commission Imphal as and when required for finding out the details of Director of Kangla Housing Construction, (A Unit of Kangla Construction Pvt. Ltd.)

 

4. That the Revision Petitioner may be allowed to withdraw the present Revision Petition with the liberty to file a Revision Petition afresh, if so advised.

 

                                               Having heard the learned counsel for both sides and on perusal of the terms and conditions set forth in the joint application, we are of the view that there would be no illegality while allowing the prayer since the above said terms and conditions are not opposed to law. Thus, it is ordered that the Revision Petition is disposed of under the terms and conditions as stated above with the liberty to the Revision Petitioner to file a Revision Petition afresh, if so advised.

                                               Revision Petition is disposed of.

                                               Send back the records to the District Commission, Imphal along with a copy of this order.
