Complainant availed the water connection from opposite party. On 17/04/2021 disconnection notice was issued by the opposite party to complainant for an amount of Rs.13,867/-. According to the complainant the average use of water is 250 KL. The complainant stated that the high amount of water bill may be due to the damage of meter. The complainant and his wife and son are the members of his family. There was no need to use the water for an amount of Rs.13,867/-. There was no leakage in water connection. The act of opposite party amounts to deficiency in service. Hence the complaint.
2. After accepting the notice, the opposite party was absent and opposite party set exparte.
3. Complainant filed proof affidavit and documents. Ext.A1 marked.
Issues to be considered are :
1. Whether there is any deficiency in service on the part of the opposite party
2. If so what is the relief and cost.

4. We perused relevant documents on records. Ext.A1 is the copy of bill dated 08.01.2021 for an amount of Rs.13,631/-. The complainant stated that the average use of the water by the complainant is for an amount of Rs.200/- below for two months. The complainant does not know the reason for increase of water bill amount. The opposite party had not produced evidence to disprove the case of complainant. In view of the above discussions and in the absence of any contra evidence we find that the act of opposite party amounts to deficiency in service.
5. As per the IA.136/21 the complainant produced bill dated 04/03/2021 for an amount of Rs.13,867/-. As per the order in IA.136/21. Opposite party was restrained from disconnecting the water supply provided to Consumer No.13053 till the disposal of the complaint.
In the result, complaint is allowed. We direct the opposite party to cancel the bills dated 08/01/2021 and 04/03/2021 & 17/04/2021 and pay Rs.5000/- as compensation for mental agony and pay Rs.2500/- as cost of the proceedings.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
