The following order of the Commission was delivered by Justice Shantanu S. Kemkar, President:
Parties through counsel. Heard.
2. This order shall govern disposal of this revision as also revision no.115/19, (The New India Assu. Co.Ltd.& Anr. vs. Ku. Pooja & Anr.). Since facts of both the cases are identical they are being decided by this common order.
3. The petitioner/opposite party is aggrieved by the order dated 08.07.2019 passed by the District Consumer Disputes Redressal Forum, Damoh, (for short ‘Forum’) in complaint case no.52/2019, whereby the Forum has proceeded ex-parte against the petitioner on the said date i.e. 08.07.2019.
4. Learned counsel for the petitioner/ opposite party submits that as is evident from the impugned order, the notice of the complaint was served on the petitioner on 25.06.2019 and thus before completion of 30 days on 08.07.2019, the Forum has proceeded ex-parte against the petitioners.
5. Thus according to the petitioner, the impugned order having been passed in violation of the provisions of the Consumer Protection Act, 1986, the same is liable to be set aside.
6. On going through the proceedings of the impugned order it is clear the notice was served on the petitioners on both the petitions on 25.06.2019 and the petitioners were proceeded ex-parte on 08.07.2019. Thus without waiting for atleast 30 days, the Forum ought not to have proceeded ex-parte against the petitioners.
7. In the result, the impugned order is set aside. The matter is remanded to the Forum for taking decision in accordance with law.
8. The petitioners of both the petitions are permitted to file reply within 15 days from the date of appearance as is fixed below.
9. The parties are directed to appear before the Forum on 28.04.2020.
