This revision petition has been filed by the revision petitioner/Opposite Party No.2, against order dated 13.03.2018 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh (in short “the Forum” only), vide which, the aforesaid revision petitioner was ordered to be proceeded against exparte. It has been stated that notice was received after 13.03.2018 and non-putting of appearance before the Forum, was not intentional or willful.
3. The revision petitioner has also filed separate miscellaneous application bearing No.383 of 2018 for condonation of delay of 12 days in filing the revision petition.
4. Let notice of the application for condonation of delay, as also of the revision petition be issued to respondent No.1/complainant.
5. Sh. Krishan Kumar, respondent No.1/complainant is present in Court, accepts notice of the application for condonation of delay as also revision petition. Copies of the same alongwith documents annexed therewith have been supplied to him. He states that he has no objection, in case, the delay aforesaid is condoned. Accordingly, the delay in filing the revision petition stands condoned.
6. Sh. Krishan Kumar, respondent No.1/complainant also very graciously states that let the complaint be heard on merits.
7. In view of above, this revision petition is allowed. Order, referred to above, is set aside.
8. Parties are directed to appear before the Forum today itself, where the main case is also listed for today.
9. Counsel for the revision petitioner undertakes to file reply and evidence/affidavit before the Forum on or before 12.07.2018. We make it very clear that in case, it is not so done, then no further opportunity shall be granted to the revision petitioner for the said purpose and the revision petition shall be deemed to have been dismissed and the order, referred to above, shall be deemed to have been confirmed.
10. Order passed is subject to payment of Rs.3,000/- as cost. Let amount of cost be paid by the revision petitioner to respondent No.1/complainant on the next date before the Forum.
11. Complete original record is sent back to the concerned Forum.
12. Certified copies of this order be sent to the parties, free of charge.
13. Certified copy of this order be sent to the Forum.
14. File be consigned to the Record Room after completion.
