Present:          Shri Om Kamboj, Adv. for the complainant.

                       Shri KK Gupta, Adv. for the respondent No.1.

                       (Notice of complaint was not ordered against respondent No.2&3).  

                                                                            

                 Shri K.K. Gupta, counsel for the respondent No.1 produced document showing, the arbitration proceeding are pending between the parties qua the dispute, which is also subject matter of the complainant. On the another hand, complainant suffered statement to withdraw the present complaint.

                  Keeping in view the statement of complainant, present complaint is dismissed as withdrawn with no order as to costs. Complainant shall be at liberty to raise his grievance before the Arbitration Tribunal and thereafter on passing of Arbitration Award, he shall be at liberty to file objection under Section 34 of the Arbitration and Conciliation Act, 1996, before the Court of competent jurisdiction. File be consigned to records.
