Respondent No. 1 is present through Ld. Advocate Mr. Karunashis Chakraborty.  Mr. Madhusudan Jana, the Ld. Advocate makes a prayer on behalf of the Ld. Advocate appearing for the Appellant asking for adjournment as the Ld. Advocate conducting this case and located in Delhi is unable to reach this Court today.  We find from the order sheets that on 08.12.2009 none appeared for the Appellant.  Then again on 07.01.2010 as Appellant was absent a direction was given to show-cause as to why the appeal would not be dismissed for default and cost was imposed of Rs.200/-.  Today a prayer is being made for adjournment but we find that neither the cause has been shown as was directed nor cost has been paid.  Mr. Jana state that he is not conducting Advocate and he is only making prayer on being requested.  We are not appreciating the conduct of the Ld. Advocate on behalf of the Appellant as no cause has been shown nor the cost has been paid, the appeal is dismissed for default.
