At the outset, Mr. Pattjoshi, learned Senior Counsel, appearing for the Appellant, states that pursuant to the directions issued in the order dated 16.01.2017, passed by the Punjab State Consumer Disputes Redressal Commission at Chandigarh (for short “the State Commission”), the Legal Manager of the Appellant Company shall appear before the State Commission on the next date of hearing, which is 06.03.2017, without prejudice to the stand of the Appellant that the bailable warrants issued against the officials of the Appellant are without jurisdiction. Learned Counsel also submits that even the Execution Application, seeking to enforce a direction with regard to the electricity connection, is not maintainable. In view of the above, this Execution Appeal is disposed of with a direction that the Legal Manager of the Appellant Company shall appear before the State Commission on the next date of hearing and, if so advised, file objections in the Execution Application. Till the said Application is disposed of by the State Commission, the bailable warrants issued against the officials, named in the impugned order, in terms of the order impugned in this Appeal, shall not be executed for a period of two weeks from the date of the order, disposing of the objections by the Appellant. The statutory deposit made while filing this Appeal shall stand transferred to the Consumer Legal Aid Account – NCDRC. Dasti. |
