Learned counsel for the petitioner and learned counsel for respondent No. 1 present. None is present for OP 2. The case was admitted on 14.8.2012. On 26.04.2013, learned counsel for the respondents wanted to submit written submissions and he was allowed to file it till 31.7.2013. On 31.72013, the written version was not filed. Therefore, the right to file the same was forfeited. Learned counsel for the petitioner submits that he had come for admission hearing. This is a frivolous argument. The case was already admitted. This question has been raised to waste the time of this Commission. He now prays that his written submissions should be taken on record and he be permitted to argue the case. In the interest of justice, we allow that the written submission be read in evidence, subject to payment of Rs.10,000/- as costs, which be deposited in the Consumer Legal Aid Account of this Commission till the next date of hearing. Learned counsel for the complainant is not ready with the arguments and prays for adjournment. The matter is adjourned to 1.12.2014 for arguments. |
