State Commission had dismissed the appeal on the ground of delay of 25 days.  Limited Notice was issued to the respondent as to why the impugned order be not set aside and the case remitted back to the State Commission to decide the appeal on merits after condoning the delay.

          After hearing the counsel for the parties, we are of the opinion that the delay of 25 days in filing the appeal deserves to be condoned.  Delay of 25 days is condoned and the case is remitted back to the State Commission to decide the same afresh in accordance with law on merits.

            Parties, through their counsel, are directed to appear before the State Commission on 11.11.2010.
