1.       This appeal filed under section 19 of the Consumer Protection Act 1986 is in challenge to the Order dated 07.07.2021 of the State Commission in complaint no. 214 of 2019.

2.       Learned counsel for the appellant (builder co.) submits on instructions that the appellant (builder co.) wishes to comply with the impugned Order in its entirety. He requests that four weeks’ time be granted to the appellant (builder co.) for the said purpose.

3.       Learned counsel for the appellant further submits on instructions that the appellant (builder co.) does not wish to pursue its appeal any more and wishes to withdraw the same. 

4.       In the wake of the above submissions, nothing remains to be adjudicated further, and the instant first appeal no. 532 of 2021 is hence dismissed as withdrawn. It is directed that if the impugned Order is not complied with by the appellant (builder co.) within four weeks, the State Commission shall undertake execution for ‘enforcement’ and for ‘penalty’, as per the law.

5.      The Registry is requested to send a copy each of this Order to the parties in the appeal and to their learned counsel immediately. The copy of the order be also communicated to the State Commission forthwith by fastest mode available. The stenographer is requested to upload this Order on the website of this Commission immediately.
