State Commission dismissed the appeal as barred by limitation.

There was a delay of 162 days in filing the appeal. 

          Counsel for the respondent states that the delay in filing the appeal before the State Commission be condoned and the case be remitted back to the State Commission to decide the appeal afresh on merits. 

          In view of the concession made by the counsel, the delay in filing the appeal is condoned.  The case is remitted back to the State Commission to decide it afresh on merits.  All contentions are left open.

          Parties, through their counsel, are directed to appear before the State Commission on 28.4.2011.

          Since it is an old matter, we would request the State Commission to dispose of the appeal within 4 months from the date of first appearance.
