Heard learned counsel for petitioner and respondent.  During pendency of proceeding before this Commission on a move by petitioner, execution of warrant issued during execution proceeding against petitioner – Authority was stayed by this Commission subject to deposit of Rs.15 lakhs with the National Commission.   We on hearing the parties remitted the matter to State Commission for fresh consideration of the issue involved giving opportunity to the petitioner to address the issue.  It is submitted on behalf of petitioner that since now this Commission is not in sesion of proceeding, petitioner be permitted to withdraw the deposit made by them.  We accordingly direct the petitioner to withdraw the deposited amount of Rs.15 lakhs with this Commission.  Respondent would be at liberty to proceed with execution proceeding pending before the District Forum. 

Miscellaneous application is disposed of accordingly.
