CC No.228 of 2023.

Poonam      Vs.    Kamboj Electronics.

 

Present:      Complainant in person.

                   Sh. Vijay Kumar Kamboj, Adv. for the respondent No.1.

                   Sh. Anand, Area Service Manager of the respondent No.2 with Sh. Jasbir Singh Rana, Adv.

 

             There was element of settlement between the parties. On the initiate of this Commission, parties entered into amicable settlement. Sh. Anand S/o Sh. Prem Chand, Area Service Manager of the respondent No.2 suffered statement, stating as a goodwill gesture, the respondent No.2 is ready to refund the cost of product shown in invoice Ex.C7 in the sum of Rs.13,000/-, subject to return of defective product by the complainant and respondent will make the payment of Rs.13,000/- within the period of 45 days from today. Complainant by suffering separate statement has agreed to the statement of Sh. Anand, Area Service Manager of the respondent No.2.

            Keeping in view statement of representative of the respondent No.2 as referred hereinbefore and the complainant, without making any adverse comment on the act and conduct of any of the respondents, matter being amicably settled, this complaint is accepted against the respondent No.2, holding it liable for making payment of Rs.13,000/- (Rupees Thirteen Thousand) only to the complainant being amount equivalent to invoice Ex.C7 within the period of 45 days from today, subject to return of old defective product subject matter of invoice Ex.C7 by the complainant against proper receipt. In case the respondent No.2 failed to make the payment as promised within the stipulated period, then it shall be liable to pay interest @ 8% (simple) per annum on the invoice amount from the date of order till actual payment. File be consigned to the records.
