ORDER PER SHRI B.A. SHAIKH, HON’BLE PRESIDING MEMBER. None present for the appellant. Respondent No. 1- Mr. Kailash Sharma in person is present. None present for the respondent No.2. This Commission issued notice to the appellant on 29/06/2013 as the appeal is received on transfer from State Commission Mumbai. Notice issued to the respondent No.2 is returned unserved with remark as “Left”. No report about service of notice to respondent No.1 is received. However, perusal of the notice on 29/06/2013 issued to the appellant on the same address given in the appeal memo. Therefore, we presume that the notice has been served to the appellant. Despite of service of notice the appellant has not appeared. Moreover, no changed address of the respondent No.2 is furnished to this Commission by the appellant for issuing fresh notice to it. We therefore, hold that as the appellants are absent, the appeal deserves to be dismissed in default. Appeal be recalled at 3.00 p.m. for order. Appeal is recalled at 3.50 p.m. for order today. Presently also none appeared for the appellant. Hence, appeal is dismissed in default. Dated:- 19/08/2013.
