This complaint has been filed under section 17 r/w.Sec.12,13, 14 of Consumer Protection Act, 1986 for the relief of direction, (1)directing the 1st opposite party to refund the amount paid by the complainant and 2nd opposite party bank alongiwth interest, loss of income and electrical bill expenses to a sum of Rs.30,10,469.50/- to the complainant, (2)directing the 1st and 2nd opposite parties to pay a sum of Rs.5,00,000/- as compensation to the complainant on account of mental agony, harassment and emotional distress suffered by the complainant due to unprofessional conduct of the opposite parties, (3)directing the 2nd opposite party to refund the amount of Rs.80,000/- alongwith interest paid by the complainant on 10.06.2013 and to recall the demand and recall of Advance notices issued by the 2nd opposite party, (4) directing the 2nd opposite party to cancel the security mortgage vide document no.7008/2012 dated 24.12.2012.
2. Notice was issued to the opposite parties. The reply was filed by the first opposite party. The complainant has been examined as CW.1 on proof affidavit, Exs.C1 to C5 marked. The case was posted for cross examination of CW.1.
3. Today when the case is came up for hearing, complainant absent, no representation for complainant. Counsel appearing for the opposite party is alone present. On verification of documents, if seems that the case is posted for appearance of the complainant as a last chance. For the reasons stated that the complainant is absent and also for the reason that the complainant is of the year 2015, the complaint is dismissed for default.
In the result, the complaint is dismissed for default. No costs.
