The learned counsel for the appellant Mr.Maliram Chaudhary submits that as per Ex. P 2 in the year 2013 flat rate was charging by the respondents and thereafter from the year 2014 when the transformer was changed, the electric consumption was started to charge according to meter reading which is contrary to the nature of electric connection. Without considering this fact the learned DCF dismissed the complaint.

 

We have considered the submissions made by the learned counsel and perused the impugned judgment dated 17.2.2021 passed in complaint case no. 285/2018 (Jagdish Vs. A.En,JVVNL ).

 

From the perusal of record of the learned DCF it reveals that complaint was filed by the appellant complainant on 19.6.2018 while according to the appellant's own document Ex. P 2 since 2014 the bills were being issued according to meter reading therefore, the issue was raised by the appellant complainant regarding flat rate. Accordingly, first cause of action for that issue was arised in the year 2014 and the

complaint was filed after four years which is clearly time barred though the complaint was dismissed on another ground but this is also a ground when the issue which was raised cannot be agitated after four years.

 

Accordingly, the appeal devoid merits which is hereby dismissed in limine.
