The matter was passed over. On the second call also none is present on behalf of petitioner. The present petition came up for hearing for the first time on 6.12.2012. On that date, petitioner sought time to place certain medical record of his ailment for the period 2009 to 2012. Same was filed by the petitioner later on and matter was adjourned to 22.4.2013. Meanwhile, petitioner filed (Miscellaneous Application No.456 of 2013) for early hearing. Application for early hearing was listed on 22.1.2013, but none appeared on behalf of petitioner on that date. Consequently, application for early hearing was dismissed. Again, petitioner filed another (Miscellaneous Application No.832 of 2012) stating that he shall be out of country and as such will be unable to attend the case on 22.4.2013. In view of petitioner request, the date of 22.4.2013 was cancelled and the matter has been listed for today. Today, none is present on behalf of petitioner. As nobody is appearing on behalf of the petitioner since morning, the petition stands dismissed in default as well as for non-prosecution.
