The complaint is filed against BSNL challenging bill issued for internet use. It is seen that the complaint is hit by Section 7B of Indian Telegraph Act and is not maintainable before the Forum. It is held by our Hon’ble Supreme Court that when there is a special remedy provided under Section 7B of Indian Telegraph Act regarding disputes in respect of telephone bills etc. then the remedy under Consumer Protection Act is by implication barred. Hence the complaint is rejected with direction to approach the arbitrator.
Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum this the 12th day of May 2014.
