ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                              JUDGMENT

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;

            “Direct the opposite parties not to disconnect the electric connection, correct the arrear bills as per Govt. rules according to the provision under agricultural scheme and compensate towards mental agony and litigation expenses”.

            The brief fact of the case is that, the complainant is an agriculturist (poultry farmer) consumer under opposite parties vide consumer No.04257832 by taking loan from bank and as per consumption regular bill has been collected from the complainant. On 21.6.2016 the officials suddenly came to the said agriculture farm and verified the meter and reported that the meter is working as ok condition without sealed and advice the complainant to install meter cover and TP box and according to the instruction of the officials the complainant installed the same with the knowledge of opposite parties. After said verification not only the officials came to the farm premises and taking the reading of the meter but also monopoly prepared the bill as like a commercial consumer instead of agricultural consumer. The State Govt. of Odisha for the benefit of all types of farmers declared that any electric connection provided for agricultural purpose will be calculated of Re.1/- per units which has been consumed for the purpose of agriculture and the said farm specially comes under agriculture but the opposite parties by violating the Govt. rules and regulations by treating the complainant as commercial consumer and prepare the bills shown that there was arrear/outstanding of Rs.1,17,000/- towards the monthly bills against the complainant and accordingly serve disconnection notice on dtd.13.10.2019 and 20.12.2019 and threatening to the complainant to disconnect the electric connection from the said farm. 

            Notice to opposite parties by Regd. Post but none of the opposite parties appeared.

            Both parties are long absent. We have gone through the records. It is averred that complainant has taken loan and constructed the farm but electricity has been charged on commercial basis which has not been disputed for which we accept the averment of complainant and direct the opposite parties to calculate the electricity charges as agricultural and not as commercial as alleged to have been done and revise the bill and complainant shall pay the bills within 15 days to opposite parties. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
