FINAL ORDER / JUDGEMENT

Hazira is filed on behalf of the complainant through advocate.

No step is taken by the O.P. nor any W.V. filed.

In view of the Conditional order passed on the previous date the case is taken up for Ex-parte hearing.

The complainant purchased a Mobile set being item MT6A(2/16) B14e, IMEI No.863035041191042 from the O.P. No1 on 08-06-2019 for Rs.6,000/- under proper receipt but on 14-06-2019 the said mobile set was found defective and the authorized Service Centre/O.P. No.2 detected the same by issuing service report dated: 15-06-2019 with fault description as T.P. self touching. Being product seller O.P. No.1 has a duty to take proper steps for servicing and repairing of the defective mobile and the O.P.1 having failed to do so has to compensate for any loss therefor.

Prima-facie case of the complainant is proved.

The complainant is entitled to get the relief as prayed for.

That the case be and the same is allowed Ex-parte against the O.P. No.1.

The O.P. No.1 is directed to pay to the complainant Rs.5,000/- within one month from this date failing which the complainant may realize the same through execution process.

Both parties be supplied copy of this Judgement free of cost.
