1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint, notice was issued to the opposite parties. The notice issued to the first opposite party was returned with endorsement “no such addressee”. Notice to second opposite party served and as the second opposite party not appeared on the date fixed for his appearance, second opposite party was called absent and set exparte. The case was subsequently posted for taking steps against first opposite party and third opposite party. As the complainant was continuously absent and not taken any steps against the opposite parties to further proceed with this complaint, a notice was issued to the complainant to appear before this commission today to further proceed with this complaint. The notice issued to the complainant was served. Complainant not appeared and not taken any steps against the opposite parties 1 & 3. In the above circumstances, we find that the complainant is not interested to further proceed with this complaint.
In the result, the complaint is dismissed for default. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
