Admittedly, the State Commission has allowed the appeal filed by the respondent without issuing notice to the petitioner in violation

of principles of natural justice.  Since the State Commission has passed the order in violation of principles of natural justice without issuing notice to the petitioner, order of the State Commission is set aside and the case is remitted back to the State Commission to decide it afresh after affording due opportunity of hearing to both the parties in accordance with law.

          Parties through their counsels are directed to appear before the State Commission on 28.05.2013.

          Petitioner would be deemed to have been served in the appeal.

          We would request the State Commission to dispose of the appeal as expeditiously as possible and preferably within a period of four months from the date of appearance.
