ORDER

1.       This revision petition has been filed under Section 21(b) of the Act 1986 in challenge to the Order dated 04.06.2014 of the State Commission in appeal no. 542 of 2013 arising out of the Order dated 28.03.2013 of the District Commission in complaint no. 321 of 2012.

2.       We have heard the learned counsel for the petitioner electricity distribution co. and have perused the record. 

3.       The matter relates to an electricity connection for a tube-well. The State Commission vide its impugned Order dated 04.06.2014 ordered the electricity distribution co. to issue demand notice to the complainant and to immediately release an electricity connection for tube-well on compliance of that demand notice. It also awarded Rs. 25,000/- as compensation and Rs.11,000/- as cost of litigation.  

3.       On the face of it we find that the State Commission has passed a well-appraised reasoned Order and has correctly assessed the facts and evidence. That being as it may, during the course of the arguments learned counsel for the electricity distribution co. submits on instructions that it is ready and willing to comply with the impugned Order of the State Commission in its entirety.  Mr. Param Pal Singh, Addl. S.E. present in person confirms. The learned counsel and the Addl. S.E. also make it clear that the demand notice that will now be issued will be at the same rate as was prevalent at the time the subject demand notice no.1846 dated 25.02.2009 was purportedly issued to the complainant i.e. in effect the same demand notice no.1846 dated 25.02.2009 will be revived mutatis mutandis.  

4.       In the wake of the above submissions, the revision petition is rendered infructuous. The electricity distribution co. shall be bound by the submissions made by its learned counsel on instructions and confirmed by its Addl. S.E. in person. The requisite demand notice shall be issued at the earliest and in all contingencies within four weeks from today.

Learned counsel submits on instructions that the above stipulated time period of four weeks from today will be adhered to. Mr. Param Pal Singh, Addl. S.E. present in person confirms.

It is also to add that consequential action thereafter shall be undertaken as per the rules of the electricity distribution co. but without ‘deficiency’ or ‘unfair or deceptive’ act.

5.       The Registry is requested to send a copy each of this Order to the parties in the petition and to the learned counsel for the petitioner electricity distribution co. and to Mr. Param Pal Singh, Addl. S.E. of the petitioner electricity distribution co. as well as to the District Commission immediately. The stenographer is also requested to upload this Order on the website of this Commission immediately.
