AWARD

     Counsel for OP has tendered a copy of letter dated 10.12.2022 sent by the OP to the complainants regarding payment of interest on account of delayed possession, which is taken on record.

     Vide e-mail dated 17.12.2022 received in the office of this Commission, counsel for complainants has sought permission to withdraw the complaint in terms of compromise deed and subject to clearance of cheque and delivery of possession of flat after completing the tower in all respects, as per law, with liberty to file fresh or revive, if need so arise.

      In view of the request of the counsel for complainants, the complaint of the complainants is dismissed as withdrawn. However, the complainants are left at liberty to file fresh complaint if there is any violation of the terms & conditions of the compromise deed, as permissible under the law.

     Certified copies of this order be sent to the parties free of cost. The file be consigned.
