Learned counsel Sh. Deepak Ahluwalia for the appellant has appeared.

A compromise is accepted on record (paper No. 76 of the appeal file), which is duly accepted by the learned counsel for both the parties.

Because the compromise has been accepted by the parties, therefore, in such circumstances the appeal deserves to be decided in the light of the terms and conditions of the above compromise.

Appeal is allowed and the compromise is hereby accepted and the appeal is decided accordingly in terms of above mentioned compromise which shall form part of the decree. No order as to costs of appeal.

The appellant is directed to pay the amount of Rs. 4,40,000/- (Rupees Four Lacs Forty Thousands only) to respondent No. 1 – complainant Sh. Jai Prakash within a period of 45 days from today, failing which the appellant shall be entitled to pay simple interest @ 8% per annum on the said amount till its actual realization.

File be consigned to the record room alongwith copy of this order.

A copy of this order alongwith copy of compromise clubbed with original record of the District Commission be sent to the concerned District Commission for perusal and necessary information.
