This is a complaint filed under section 35 of the Consumer Protection Act, 2019 alleging unfair trade practice and deficiency of service on the part of the opposite party and seeking return of the pets of the complainant which were entrusted to the opposite party for care and protection, along with compensation of Rs. 50,000/- for the mental agony and hardship suffered.
- The opposite party was set ex-parte.
- Today the case is posted for the affidavit of the complainant as last chance. But the complainant remained absent and there is no representation for him. The onus is on the complainant to prove the allegations. But the complainant failed to let in any evidence to prove the case so as to get an order as prayed for. The allegations are not proved. The complainant is continuously absent and it appears that he is not interested in pursuing the matter.
In the result, the complaint is dismissed. No order as to costs.
