Jogindero vs. Ishan.

                       The execution petition taken up on today for arguments, on the point of review of order dated 3.1.2024, however, counsel for petitioner stated at bar, during the pendency of First Appeal No.1205 of 2023 filed by the opponent, being aggrieved from order dated 27.7.2023. The petitioner is not willing to withdraw the awarded amount, deposited by the opponent in this Commission.  In view of the submission of the counsel for petitioner, record of present execution petition is hereby ordered to be consigned to the records, treating the execution petition having become infructuous and after the decision of the first appeal, the petitioner shall be at liberty to file a fresh execution petition, if advised so and in the fresh execution petition, he will disclose the particulars of the present execution petition and will attach the copy of this order. File be consigned to the records.
